1. Purpose of this Disclaimer

JetScribe is an automated transcription and summarization tool operated by JP Fractal Works UG (haftungsbeschränkt). This Disclaimer explains the limits of what our website and our automated output can be relied on for.

It supplements our Terms and Conditions and Terms of Use. It does not exclude or limit any liability that cannot lawfully be excluded or limited — in particular the mandatory liability described in section 14.

2. Automated output is not guaranteed to be accurate

Transcripts, speaker labels, timestamps, titles, and summaries are produced by automated speech recognition and language models. They can and do contain errors: misheard or missing words, omitted passages, speech attributed to the wrong speaker, imprecise timings, and summaries that state something the recording does not support.

Accuracy depends on recording quality, microphone distance, background noise, overlapping speech, accent and dialect, specialist terminology, language, and recording length. We do not warrant any particular accuracy rate. Any accuracy figure mentioned in marketing material illustrates what is achievable with favourable recordings and is not a promise for your material.

Always review output against the source recording before you rely on it, and never treat it as the sole record where an error would matter.

3. No professional advice

Nothing on the JetScribe website, and nothing produced by the Service, constitutes legal, medical, financial, tax, accounting, employment, or other professional advice. No advisory, professional, or fiduciary relationship arises from using JetScribe. Consult a qualified professional before acting on anything derived from a transcript or summary.

4. Not designed for critical or high-risk use

JetScribe is a general-purpose productivity tool. It is not designed, tested, certified, or approved for use as a certified medical device, as a certified captioning or accessibility service, as sworn translation, or as verbatim court reporting. If you use it in any of the contexts listed below, you do so on your own responsibility and only after your own verification.

• Official records of courts, parliaments, authorities, or police.
• Medical diagnosis, treatment decisions, or clinical documentation.
• Regulatory, statutory, or tax filings.
• Evidence in legal, disciplinary, or immigration proceedings.
• Safety-critical, emergency, or real-time decision-making.
• Any use where an error could lead to injury, loss of liberty, or significant financial or legal harm.

5. Dependence on third-party services

The Service depends on third parties, including Google Cloud and Firebase for infrastructure, our speech-to-text providers for transcription, and Stripe for payments. Interruptions, changes, quality variations, or errors at those providers affect JetScribe. We do not warrant uninterrupted or error-free operation and we cannot be responsible for the conduct or the terms of those providers beyond our own contractual obligations to you.

6. Liability for our own content

As a service provider we are responsible for our own content on these pages under the general laws (§ 7(1) DDG). We prepare that content with care, but we do not warrant that it is complete, current, or free of errors, and we may change it at any time.

Obvious errors in prices or plan descriptions on our website do not bind us. What applies to your purchase is the price shown in the Stripe checkout at the moment you complete it.

7. Liability for links

Our pages contain links to external websites over whose content we have no influence. The respective provider or operator of the linked pages is always responsible for their content. The linked pages were checked for possible legal infringements at the time of linking, and no unlawful content was apparent.

Permanent monitoring of the content of linked pages is not reasonable without concrete indications of an infringement. If we become aware of a legal infringement, we remove the link immediately.

8. Content uploaded by users

Content uploaded by users is not our content and we do not adopt it as our own. As a hosting service provider we are not obliged to monitor stored content or to investigate circumstances indicating unlawful activity (§§ 7 to 10 DDG, Art. 6 and 8 of Regulation (EU) 2022/2065).

Our obligation to remove or block access to specific content once we obtain actual knowledge of its unlawfulness remains unaffected. Any liability in that respect arises only from the moment we obtain such knowledge. See our Copyright Statement for how to report an infringement.

9. Recordings, consent, and confidentiality

You alone decide what to upload. Whether a recording was lawfully made, whether the people recorded consented, and whether transcribing the recording through a service provider is permitted in your context are questions you must answer before you upload. We do not review your material for lawfulness and give no assurance about it. See section 7 of the Terms and Conditions.

10. Data loss and backups

JetScribe is not a backup or archiving service. Keep your own copies of source recordings and of transcripts that matter to you, and export them regularly. We are not responsible for material you have not kept a copy of, beyond the limits set out in section 14.

11. Security

We apply appropriate technical and organisational measures to protect the Service, including encryption in transit, encryption at rest by our infrastructure providers, and server-side access rules. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

12. Beta features and statements about the future

Features described as beta, preview, or experimental are made available for evaluation, may be changed or withdrawn at any time without notice, and may be less reliable than the rest of the Service. Statements about planned features, roadmaps, or future performance describe our current intention and are not binding commitments.

13. Examples, testimonials, and results

Sample transcripts, case studies, screenshots, and user statements shown on our website illustrate individual results achieved under particular conditions. They are not a guarantee, warranty, or prediction that you will achieve comparable results.

14. Limitation of liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body, or health, for claims under the German Product Liability Act, for fraudulently concealed defects, and to the extent we have given a guarantee.

In cases of slight negligence we are liable only for the breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely — and in that case only for the foreseeable damage typical for this type of contract.

Any further liability is excluded. Liability for loss of data is limited to the effort required to restore data that would have been recoverable from backups you maintained with reasonable care. The above limitations also apply to the personal liability of our legal representatives, employees, and vicarious agents. No change in the burden of proof to your disadvantage is associated with them.

Nothing in this Disclaimer excludes or limits liability that cannot be excluded or limited under German law, and nothing in it restricts the statutory rights of consumers.
