Intellectual Property Rights
Who owns what: our platform and brand, your recordings and transcripts, and the limits of each licence.
1. Overview
This page explains the intellectual property position between you and JP Fractal Works UG (haftungsbeschränkt). In short: we own JetScribe, you own what you upload, and each side grants the other only the narrow licence needed to make the Service work. This page forms part of our Terms and Conditions.
2. What we own
The JetScribe service — including its source code, software, application programming interfaces, user interface, layout, visual design, graphics, icons, illustrations, text, documentation, database structure, and the selection and arrangement of its content — is owned by us or licensed to us. It is protected by copyright under the German Copyright Act (UrhG), by database rights under §§ 87a ff. UrhG, by trade mark law, and by the law against unfair competition.
Nothing on the Site should be read as granting, by implication, estoppel, or otherwise, any licence or right beyond those expressly described here.
3. Trade marks and brand
"JetScribe", the JetScribe logo, and our product and feature names are our trade marks or business designations within the meaning of § 5 MarkenG. You may not use them without our prior written consent.
Purely factual, editorial references to JetScribe are permitted where they do not suggest an affiliation, sponsorship, or endorsement that does not exist, do not alter or restyle our marks, and do not use them more prominently than your own. Third-party names and marks mentioned on our Site belong to their respective owners; mentioning them implies no association.
4. The licence we grant you
Subject to these terms, to the Terms and Conditions, and to payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Service for your own personal or internal business purposes for the duration of your contract. The right ends automatically when the contract ends.
5. What that licence does not allow
- Copying, distributing, publicly communicating, or making available any part of the Service beyond what ordinary technical use requires.
- Modifying, translating, adapting, or creating derivative works from the Service.
- Decompiling or reverse engineering the Service, except to the extent permitted by mandatory law such as § 69e UrhG, and then only after you have asked us in writing for the interoperability information you need.
- Renting, leasing, reselling, sublicensing, hosting as a service, or white-labelling the Service.
- Extracting or reusing substantial parts of our databases, or repeatedly and systematically extracting insubstantial parts, contrary to § 87b UrhG.
- Removing, obscuring, or altering copyright, trade mark, or other proprietary notices.
- Using the Service or its output to develop, train, fine-tune, evaluate, or benchmark a competing product or a machine-learning model.
- Publishing benchmarks or performance comparisons of the Service without our prior written consent.
6. What you own
You keep every right you already hold in the files you upload. Uploading transfers no ownership to us and creates no joint ownership.
The licence you grant us is limited to hosting, storing, copying, transmitting, processing, reformatting, and displaying your content in order to provide, secure, and support the Service for you, and to letting the processors named in our Privacy Policy do the same for that purpose. It ends when you delete the content or your account, except for copies remaining temporarily in routine backups.
We do not use your content to train models, we do not license it to third parties for their own purposes, and we do not sell it.
7. Transcripts and other output
As between you and us, the output generated from your files is yours to use without restriction by us.
Please note two limits that come from the law rather than from us. First, purely machine-generated text may not itself attract copyright protection in Germany, because copyright requires a personal intellectual creation within the meaning of § 2(2) UrhG. Second, rights in the underlying recording, and in any work spoken, performed, or played within it, are unaffected: transcribing a protected lecture, song, broadcast, interview, or film gives you no rights in that material.
You remain responsible for ensuring that your use of output respects the rights of the people recorded and of the rights holders in the underlying material.
8. Feedback and suggestions
If you send us ideas, suggestions, feature requests, bug reports, or other feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable right to use, reproduce, modify, and exploit it without restriction and without any obligation of compensation, confidentiality, or attribution.
Please do not send us feedback that you are not free to share, or that contains confidential information belonging to someone else.
9. Text and data mining
Our public pages are published so that they can be read, quoted, and cited. They are open to crawling, indexing, and retrieval by automated services, including AI search assistants and model developers, in accordance with our robots.txt. We make no text and data mining reservation over them.
We do expressly reserve the right of text and data mining, within the meaning of § 44b(3) UrhG and Art. 4(3) of Directive (EU) 2019/790, with respect to the JetScribe application and to the output the Service produces. Those require an account and are not publicly accessible. Text and data mining of them beyond the mandatory research exception in § 60d UrhG requires our prior written consent.
10. Third-party and open-source components
The Service includes third-party and open-source components that are licensed by their respective owners. Those licences govern those components and, where they grant you rights, nothing on this page restricts them. A list of the components we use is available on request at support@jetscribe.ai.
11. Reporting an infringement
If you believe that content on JetScribe infringes your intellectual property rights, please follow the notice procedure in our Copyright Statement, which also applies to trade mark and other IP complaints. Notices of illegal content under Art. 16 of Regulation (EU) 2022/2065 can be sent to the same address, support@jetscribe.ai.
12. Consequences of infringement
Where an infringement is apparent we remove or block the affected content, and we may suspend or terminate the account responsible. Repeated infringement leads to termination after a prior warning, where a warning is appropriate.
We reserve all remedies available to us, including injunctive relief, information, and damages under §§ 97 ff. UrhG and the corresponding provisions of trade mark and competition law.
